Council demolition requirements

Demolishing a house in the Cumberland Council area

What Cumberland Council publishes about demolition approvals, heritage, trees and site conditions, read from its own pages on 21 September 2026. The council or certifier confirms the pathway for your address.

Covers 20 suburbs we service across Parramatta, South West Sydney and the Inner West.

How the council handles demolition approvals

Cumberland Council needs a notice of commencement at least five days before work starts, covering asbestos cement, written notice to neighbours and a booked pre-demolition inspection. The DA needs a waste management plan, and tip receipts are due within 14 days of finishing.

Heritage items and conservation areas

In Cumberland, heritage items and heritage conservation areas carry special planning controls, with listings in the local environmental plan and inventory sheets by suburb.

Trees on the block

The council’s Tree Works Application is used to seek approval for tree work on a property, and it publishes a list of qualified arborists and a tree species list.

Flood and bushfire mapping

Bushfire prone land is one of the mandatory disclosures on a section 10.7 planning certificate, according to the council.

Fees, bonds and public land

Security deposits set as a condition of consent must be paid before a Construction Certificate is issued, and hoarding applications need a footpath bond.

Also worth knowing

Cumberland also has a photographic record checklist for buildings being demolished.

What applies in every council area

Council requirements sit on top of state rules that do not change from one area to the next.

  1. Approval pathway

Most house demolition needs either a development application to the council or a complying development certificate from the council or a registered certifier under the state Demolition Code. Heritage items and conservation areas are generally excluded from the complying pathway.

  2. Licensed demolition

Demolition work is licensed by SafeWork NSW. Gabrael holds restricted demolition licence AD202697 (DE2) and lodges the required notifications for the work it carries out.

  3. Asbestos

Suspected asbestos must be assessed before the building is disturbed. Our Class B licence AD211249 covers bonded, non-friable material; friable asbestos is removed by our Class A licensed partner.

  4. Utilities

Water, sewer, electricity, gas and telecommunications are disconnected or abolished through the providers before demolition, and Before You Dig Australia is checked for services.

  5. Neighbours

Approval conditions commonly set working hours and neighbour notice, and a dilapidation report protects both sides where buildings sit close to the boundary.

  6. Waste

Concrete, timber and metals are sorted for licensed recycling and asbestos goes to an approved disposal facility with documentation. Some councils ask for a waste plan with the application.
